Diffiniad o Anghenion Addysgol Arbennig (yn y cod ymarfer AAA cyfredol)
Mae'r diffiniad o Anghenion Addysgol Arbennig (AAA) yn y ddeddfwriaeth gyfredol yn nodi bod gan blant anghenion addysgol arbennig os oes ganddynt anhawster dysgu sy'n galw am wneud darpariaeth addysgol arbennig ar eu cyfer. Mae plant yn cael anhawster dysgu os ydyn nhw:
(a) yn cael anhawster sylweddol fwy wrth ddysgu na mwyafrif y plant o'r un oed; neu
(b) bod ag anabledd sy'n eu hatal neu'n eu rhwystro rhag defnyddio cyfleusterau addysgol o fath a ddarperir yn gyffredinol ar gyfer plant o'r un oed mewn ysgolion yn ardal yr awdurdod addysg lleol
(c) o dan oedran ysgol gorfodol ac yn dod o fewn y diffiniad yn (a) neu (b) uchod neu byddent yn gwneud hynny pe na bai darpariaeth addysgol arbennig yn cael ei gwneud ar eu cyfer
Mae darpariaeth addysgol arbennig yn 'ychwanegol at, neu'n wahanol i'r ddarpariaeth addysgol a wneir yn gyffredinol ar gyfer plant o'u hoedran mewn ysgolion a gynhelir gan yr awdurdod lleol, ac eithrio ysgolion arbennig, yn yr ardal.' (Deddf Addysg 1996)
Definition of Special Educational Needs (in the current SEN code of practise)
The definition of Special Educational Needs (SEN) within current legislation states that children have special educational needs if they have a learning difficulty which calls for special educational provision to be made for them. Children have a learning difficulty if they:
(a)have a significantly greater difficulty in learning than the majority of children of the same age; or
(b)have a disability which prevents or hinders them from making use of educational facilities of a kind generally provided for children of the same age in schools within the area of the local education authority
(c)are under compulsory school age and fall within the definition at (a) or (b) above or would do so if special educational provision was not made for them
Special educational provision is 'additional to, or otherwise different from, the educational provision made generally for children of their age in schools maintained by the local authority, other than special schools, in the area.' (Education Act 1996)
